Terms & Conditions

IMPORTANT: Please read this document carefully. It is a condition of your use of our services that you comply with these terms and conditions. These terms and conditions apply to all goods or services supplied by Fine Tuned Fitness Ltd. They are to be read in addition to and will prevail over any additional terms and conditions specified for any individual purchase of one on one Personal Training sessions or Online packages supplied by Fine Tuned Fitness Ltd (FTF). In so committing to Fine Tuned Fitness Ltd and or Personal Training, I acknowledge, warrant and agree that: 

1. Client Policy: 
All Clients must consult a medical professional before commencing any exercise or nutritional program supplied by FTF.   

2. Terms of Payment: 
Payment is due weekly to FTF via FTFs direct debit provider STRIPE and the member has read and agreed with Stripes direct debit terms. Direct debit and credit card payments are deducted by Stripe. For Stripe's terms and conditions, please visit https://stripe.com/nz/checkout/legal
Minimum term of the payments will be from the client commencement of the chosen service. 
FTF may withhold or refuse delivery of its services to the client until such time that all payments are up to date. 
In the event of a failed Direct Debit payment, the member will incur a fee, which will be added to the next successful payment. This cost will vary depending on the charges imposed by the Direct Debit Company controlling the debit from the members account or credit card. 
After the term finish date, the client remains an active FTF member and the member will not need to join again, hence the payments will continue to be withdrawn once the new term commences. 

3. Refund: 
Once the client has commenced the online term, the client is not entitled to a refund for any reason.
4. Cancellations:
A client, once commenced, may cancel with a minimum of 14 days written notice and payments will continue until such time is completed. 
Should the client decide not to continue with the service in the NEW term, they will need to inform FTF in writing via email to finetfitness@gmail.com 1 week prior to the new term commencement date. 
A client may be suspend service due to medical reasons once a doctors certificate has been provided outlining the members condition. Suspended membership will incur an admin fee of $10 (ten dollars) per month. If the total time of the suspension is less than one month, the member will still be charged the $10 admin fee. 

5. FTFs Rights: FTF may:
Cancel or postpone a service at anytime.
Representatives have deemed (at their sole discretion) the client to be medically or physically unfit to participate. However, FTF is not able to provide advice concerning the members medical fitness to undertake exercise or activity and that is the members responsibility to seek medical advice in this regard. 

6. MEMBER CONSENT:
Warning: Participation in FTF online and FTF Personal Training can be inherently dangerous. Accidents may happen which may result in personal injury. I have read and understood this warning and voluntarily accept and assume the inherent risks in participating in each relevant FTF session or exercise program. 
Fitness to Participate: I warrant that I am physically and medically sound to proceed with an FTF exercise program. I will notify FYT in writing of any change to my fitness and ability to participate. 
Medical Treatment: I consent and authorize FTF and its Representatives to administer or obtain medical assistance in the event of an accident or medical condition I may suffer whilst participating in the FTF sessions and agree to pay for any costs or expenses incurred by FTF in administering or obtaining such medical assistance. 
Indemnity
You specifically indemnify and hold harmless FTF in respect of any event which might otherwise have given rise to a cause of direct or indirect action (in respect of you or any person in your care) against any or all of the persons or organizations protected in this clause. You provide the indemnity with the knowledge of and in recognition of the possibility of injury or other dangers connected with any form of physical activity including the activity usually included in membership. You must not undertake any physical activity if you suffer from any injury, illness or disability which might cause additional injury or aggravation to such condition.
Photographs and right to use: Photos & videos may be taken and used by FTF without compensation to me. I understand such photos are and will remain the property of FTF for promotional purposes only. 
7. I have read, understood, acknowledge and agree to the above declaration and acknowledge that during all such times whilst participating in a FTF exercise session both my property and my person shall be at my own risk and I will not hold FTF or its Personal Trainers liable for any personal injury or loss of property, whether caused by negligence by FTF, its servants or agents.

Missed Payments
Missed payments will incur a $2.50 Administration Fee. Any bank charges incurred are not refundable.
